DMCA & INTELLECTUAL PROPERTY POLICY
Last Updated: December 28, 2025
Next Spacey LLC ("Company," "We," "Us," or "3D Spacey") operate as a technical service provider under the Digital Millennium Copyright Act ("DMCA"). We respect the intellectual property of creators and have established this protocol to resolve claims of infringement in a fair, transparent, and legally compliant manner.
1. DESIGNATED COPYRIGHT AGENT
To report an infringement, please send a formal "Notice of Alleged Infringement" to our Designated Agent. Communication via email is preferred for expedited processing:
Attn: Copyright Compliance Department
Company: Next Spacey LLC
Address: 400 Rella Blvd, Ste. 207-173, Montebello, NY 10901, USA
Email: [email protected]
2. REQUIREMENTS FOR SUBMITTING A NOTICE
To prevent malicious or fraudulent reports, your Notice must be in writing and include the following:
Proof of Original Work: A clear identification of the copyrighted work claimed to have been infringed. You must provide a direct URL to the original source (e.g., your personal portfolio, official store listing on a reputable platform, or your website) to serve as evidence of ownership.
Identification of Infringing Material: The specific URL or Asset ID on 3D Spacey that contains the material you claim is infringing.
Contact Information: Your full legal name, physical mailing address, telephone number, and email address.
Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Penalty of Perjury Statement: A statement that the information in the notification is accurate, and UNDER PENALTY OF PERJURY, that you are the owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Signature: A physical or electronic signature of the copyright owner or authorized representative.
Note: Notices that fail to provide a link to the original work or omit the Perjury Statement will be deemed "defective" and will not be processed until complete.
3. OUR RESPONSE & VERIFICATION PROTOCOL
Upon receipt of a valid DMCA Notice, Next Spacey LLC follows an internal verification protocol:
Verification Window: Our compliance team will review the validity of the Notice and the provided evidence within 3 to 5 business days.
Expeditious Disabling: If the Notice is valid, we will act expeditiously to disable public access to the infringing material within our Software's Online Mode.
Creator Notification: We will simultaneously notify the Creator who uploaded the material, providing them with a copy of the original Notice.
Revenue Freeze: Any pending payouts or accumulated revenue associated with the disputed Asset will be frozen/held in escrow until the dispute is resolved.
Archival Preservation: We reserve the right to maintain an encrypted, non-public archival copy of the Asset for legal evidence and system integrity purposes.
4. COUNTER-NOTIFICATION PROCEDURE
If a Creator believes their material was removed by mistake or misidentification (e.g., they hold a valid non-exclusive right to distribute on multiple platforms), they may file a Counter-Notice. This must include:
Identification of the removed material.
A statement under penalty of perjury of a "good faith belief" that the removal was a result of mistake.
Creator’s contact information and a statement consenting to the jurisdiction of the Federal District Court in Wyoming, USA.
Physical or electronic signature.
If a valid Counter-Notice is received, we may restore the material in 10 to 14 business days unless the complaining party provides proof of filing a court action against the Creator.
5. REPEAT INFRINGER POLICY (THREE-STRIKES)
Next Spacey LLC maintains a zero-tolerance policy for professional piracy.
Termination: Accounts found to have committed three (3) separate acts of infringement will be permanently terminated.
Hardware Ban: Upon termination for repeat infringement, the user’s Hardware ID (HWID) and payment identifiers will be blacklisted to prevent them from re-entering the platform.
6. TRADEMARK & REAL-WORLD DESIGNS (REPLICAS)
3D Spacey is a marketplace for architectural visualization and digital design. We distinguish between "Digital File Theft" and "Artistic Representation."
Permitted Replicas: Creators are permitted to upload original 3D models representing real-world products (e.g., furniture, vehicles, or electronics). These are considered "Digital Replicas."
Originality Requirement: To be permitted, the 3D file (mesh, textures, and mapping) must be 100% created by the Creator. Uploading files originally created or distributed by competing 3D asset platforms is strictly prohibited and constitutes a violation of this policy.
Trademark Use: Some Assets may contain trademarked logos for realism. Use of such Assets in commercial projects may require additional clearances from the brand owner. Next Spacey LLC licenses only the digital artistry of the Creator and does not grant any rights to the underlying physical design or trademark.
7. LIMITATION OF LIABILITY
Next Spacey LLC is a technical intermediary and does not adjudicate copyright disputes. By using the Service, all parties agree that Next Spacey LLC shall not be liable for any damages resulting from the good-faith removal or restoration of material in compliance with this DMCA Policy.
